What Do You Need to Know About Well and Septic Systems Before Buying in Park County?

If you are looking at rural property anywhere in Park County, there is a good chance it is not connected to city water or city sewer. That means a well for your water and a septic system for your waste. For buyers coming from a city or a suburb, this is unfamiliar territory. For buyers from other rural areas, Montana has its own rules, and some of them changed in 2026.

This is a practical guide to how wells and septic systems work on Park County property, what to check during due diligence, what the current regulations require, and where the costs actually land.

The short answer: Most rural property in Park County relies on a private well and an onsite septic system. Montana requires licensed drillers for wells and county sanitarian approval for septic systems. As of January 1, 2026, new exempt wells require a Notice of Intent filed with DNRC before the water is put to use. Well water quality is the owner's responsibility to test, and the condition of an existing septic system should be verified before closing.

How Do Wells Work on Rural Property in Park County?

Most domestic wells in Park County are drilled by a licensed water well contractor into underground aquifers, lined with steel or plastic casing (usually 4 to 8 inches in diameter), and fitted with a pump that brings water to the surface. Wells are the primary water source for the majority of rural homes and ranches outside of Livingston's municipal water system.

Montana law requires that all wells be drilled by a contractor licensed through the Montana Board of Water Well Contractors. Licensed contractors must carry a $4,000 surety bond as a condition of licensure (DNRC, "Water Well Drilling for the Prospective Well Owner"). Do not hire an unlicensed person to drill your well. You can verify a driller's license through the Board.

After drilling, the contractor files a Well Log Report (Form 603) with the Montana Bureau of Mines and Geology within 60 days of completing the work. That log records the well depth, geology encountered, casing details, and water yield. Well logs for most wells in Montana are searchable through the Ground Water Information Center (GWIC).

Water rights are separate from the well itself. A well log does not establish a water right. The property owner must file a Notice of Completion of Groundwater Development (Form 602) with DNRC within 60 days after putting the water to beneficial use. The priority date of the water right is the date DNRC receives the completed form, not the date the well was drilled.

What Changed About Montana Exempt Well Rules in 2026?

This matters for anyone buying vacant land with the intention of drilling a new well.

Most domestic wells in Montana are classified as "exempt" wells, meaning they use 35 gallons per minute or less and do not exceed 10 acre-feet per year. Exempt wells have historically been excepted from the full water rights permitting process (DNRC, "Exceptions to Permit Requirements").

As of January 1, 2026, the process changed. Anyone planning to develop an exempt well must now file a Notice of Intent to Appropriate Groundwater (Form 602I) with DNRC before the water is put to use. Previously, filing happened only after the well was in use. The fee is $400, and DNRC will review and authorize or deny the Notice of Intent within 10 business days.

DNRC can no longer process a Notice of Completion (Form 602) without an authorized Notice of Intent, unless the form was pending with DNRC prior to January 1, 2026.

There is also a combined appropriation rule: two or more groundwater appropriations from the same source cannot exceed 10 acre-feet per year combined. For subdivisions, all lots in a multi-phase development must share that 10 acre-feet limit to qualify for the permit exception.

What Should You Know About Septic Systems Before Buying?

If a property is not connected to municipal sewer, it uses an onsite wastewater treatment system, which most people call a septic system. In Park County, septic permitting is handled by the Park County Environmental Health Department, and systems must comply with Montana DEQ Circular 4, the state's standards for subsurface wastewater treatment systems (most recent edition December 2023).

How a conventional system works: Wastewater flows from the house into a septic tank (minimum 1,000 gallons per DEQ Circular 4) where solids settle and grease floats. The liquid effluent then flows into an absorption field (drain field) where soil microbes treat it before it reaches groundwater.

When conventional systems do not work: If the soil drains too slowly, the water table is too high, or bedrock is too shallow, a conventional gravity system may not be suitable. DEQ Circular 4 requires a minimum of four feet of natural soil between the bottom of the absorption trench and the seasonally high groundwater level, bedrock, or other limiting layer. Properties that cannot meet this requirement need an engineered alternative, such as a mound system, sand filter, or aerobic treatment unit.

Permitting in Park County: A permit from the county sanitarian is required for every new system, major repair, or replacement. The site evaluation, including soil profiles, must be completed by a qualified Professional Engineer, Registered Sanitarian, or Park County Licensed Site Evaluator. All systems must be inspected by the department before backfilling (Park County Onsite Wastewater Treatment Regulations).

Setbacks matter: Under Montana's rules (ARM 17.36.323), an individual or shared well must sit at least 50 feet from a septic tank or sewer line, and at least 100 feet from the drain field (absorption field). One exception catches people: a public or multiple-user well, meaning a shared community system serving a subdivision (generally 10 or more families), must be 100 feet from the septic tank, not 50. On smaller parcels, meeting these distances can be a constraint.

How Do You Evaluate a Well and Septic During Due Diligence?

This is the due diligence checklist that should happen before closing on any rural Park County property.

For the well:

  1. Request the well log. Search GWIC by owner name and county, or ask the seller for a copy. The log tells you depth, yield (gallons per minute), casing type, and geology.

  2. Confirm the water right. A well log is not a water right. Verify that a Groundwater Certificate (Form 602) was filed with DNRC. If it was not, the well may not have a legally established water right.

  3. Test the water.   4. For raw land with no existing system: Request a site evaluation (soil profile and, where required, a percolation test) before closing. If the soil cannot support a septic system, the land may not be buildable for residential use without an expensive engineered alternative.

Cost is one of the first questions buyers ask, and it is also where the most misleading information circulates. Costs for wells and septic systems vary enormously based on depth, geology, terrain, distance from roads, soil conditions, and system type. The ranges below are typical for Montana in 2025-2026, but actual costs on your specific property may fall outside these ranges. Get quotes from licensed local contractors before committing to a purchase.

Well drilling (complete system):

The primary cost driver is depth. A 150-foot well in valley-floor alluvial gravel is a very different project than a 400-foot well on a bench with rocky formations. Buyers from municipal water and sewer areas sometimes treat well and septic as a red flag. That reaction is mostly unfounded, but the responsibilities are real.

You are responsible for your own water quality. Montana does not monitor private well water. There is no agency testing it for you. If contaminants are present (bacteria, nitrate, arsenic, or anything else), you find out by testing or you find out the hard way. About 10% of wells tested through MSU Extension's Well Educated program have shown arsenic or manganese above health thresholds. Nitrate above the drinking water threshold has been found in about 3% of samples.

You are responsible for your own wastewater. A neglected septic system does not just stop working quietly. It surfaces, it smells, and it contaminates groundwater. A water test shows bacteria and nitrate within safe levels but arsenic slightly above the EPA threshold of 10 micrograms per liter. The buyer learns that a point-of-use treatment system for arsenic typically costs $500 to $2,000 to install.

The septic tank is pumped during the inspection period. The pumper reports the baffles are intact but notes the tank has not been serviced in at least six years. The drain field shows no signs of failure.

The buyer closes with a clear understanding of what the property needs: an arsenic filter, regular septic pumping going forward, and a well pump inspection within the next year.

That is a good outcome. The problems that cost real money are the ones nobody checks for.
